Is a given instance of rape more likely to result in pregnancy than a given instance of consensual sex? This paper undertakes a review and critique of the literature on rape-pregnancy. Next, it presents our own estimation, from U.S. government data, of pregnancy rates for reproductive age victims of penile-vaginal rape. Using data on birth control usage from the Statisticalof the United States, we then form an estimate of rapepregnancy rates adjusted for the substantial number of women in our sample (...) who would likely have been protected by oral contraception or an IUD. Our analysis suggests that per-incident rape-pregnancy rates exceed per-incident consensual pregnancy rates by a sizable margin, even before adjusting for the use of relevant forms of birth control. Possible explanations for this phenomenon are discussed, as are its implications to ongoing debates over the ultimate causes of rape. (shrink)

Introduction Deep brain stimulation (DBS) is approved under a humanitarian device exemption to manage treatment-resistant obsessive-compulsive disorder (TR-OCD) in adults. It is possible that DBS may be trialed or used clinically off-label in children and adolescents with TR-OCD in the future. DBS is already used to manage treatment-resistant childhood dystonia. Evidence suggests it is a safe and effective intervention for certain types of dystonia. Important questions remain unanswered about the use of DBS in children and adolescents with TR-OCD, including whether (...) mental health clinicians would refer pediatric patients for DBS, and who would be a good candidate for DBS.Objectives To explore mental health clinicians’ views on what clinical and psychosocial factors they would consider when determining which children with OCD would be good DBS candidates.Materials and Methods In depth, semi-structured interviews were conducted with n = 25 mental health clinicians who treat pediatric patients with OCD. The interviews were transcribed, coded, and analyzed using thematic content analysis. Three questions focused on key, clinical, and psychosocial factors for assessing candidacy were analyzed to explore respondent views on candidacy factors. Our analysis details nine overarching themes expressed by clinicians, namely the patient’s previous OCD treatment, OCD severity, motivation to commit to treatment, presence of comorbid conditions, family environment, education on DBS, quality of life, accessibility to treatment, and patient age and maturity.Conclusions Clinicians generally saw considering DBS treatment in youth as a last resort and only for very specific cases. DBS referral was predominantly viewed as acceptable for children with severe TR-OCD who have undertaken intensive, appropriate treatment without success, whose OCD has significantly reduced their quality of life, and who exhibit strong motivation to continue treatment given the right environment. Appropriate safeguards, eligibility criteria, and procedures should be discussed and identified before DBS for childhood TR-OCD becomes practice. (shrink)

Evaluative processes have their roots in early evolutionary history, as survival is dependent on an organism’s ability to identify and respond appropriately to positive, rewarding or otherwise salubrious stimuli as well as to negative, noxious, or injurious stimuli. Consequently, evaluative processes are ubiquitous in the animal kingdom and are represented at multiple levels of the nervous system, including the lowest levels of the neuraxis. While evolution has sculpted higher level evaluative systems into complex and sophisticated information-processing networks, they do not (...) come to replace, but rather to interact with more primitive lower level representations. Toddlers exhibit poor transfer between video and real-world contexts. Contingently responsive video such as that found in touchscreen apps appears to assist transfer for some toddlers but not others. This study investigated the extent to which toddlers' working memory moderates the impact of contingency on toddler's transfer of learning from video. Toddlers watched a hiding event on either contingent video that advanced only after touch input or non-contingent video that proceeded automatically. Toddlers then searched for a corresponding object on a (...) felt board. Additionally, toddlers' working memory was assessed. Findings indicate WM and age moderated the impact of contingency on transfer: Contingency decreased transfer in younger children while increasing transfer among older children. However, this was only true for children with relatively low WM. Contingency had little impact on transfer among children with relatively high WM, regardless of age. Results from this study suggest that WM is one specific moderator that predicts whether toddlers are likely to learn from contingent vs. non-contingent video, yet WM does not operate in isolation. Together, these findings underscore the importance of considering multiple child characteristics when identifying the optimal conditions for toddlers' learning from symbolic media. (shrink)

The benefits of belonging for academic performance and persistence have been examined primarily in terms of subjective perceptions of social belonging, but feeling ability belonging, or fit with one’s peers intellectually, is likely also important for academic success. This may particularly be the case in male-dominated fields, where inherent genius and natural talent are viewed as prerequisites for success. We tested the hypothesis that social and ability belonging each explain intentions to persist in physical science, technology, engineering, and math (pSTEM). (...) We further explore whether women experience lower social and ability belonging than men on average in pSTEM and whether belonging more strongly relates to intentions to persist for women. At three time points throughout a semester, we assessed undergraduate pSTEM majors enrolled in a foundational calculus or physics course. Women reported lower pSTEM ability belonging and self-efficacy than men but higher identification with pSTEM. End-of-semester social belonging, ability belonging, and identification predicted intentions to persist in pSTEM, with a stronger relationship between social belonging and intentions to persist in pSTEM for women than men. These findings held after controlling for prior and current academic performance, as well as two conventional psychological predictors of academic success. (shrink)

This pilot randomized controlled trial explored the feasibility, acceptability, and potential utility of an intervention to improve the decisional capacity (DC) for research consent/assent among youth living with HIV (YLWH). We randomly assigned 30 YLWH aged 13–24 to a control (paper-based) or intervention (multimedia) consent/assent condition. Using a between- and within-subjects design, participants completed a demographic questionnaire and measures of DC, acceptability/feasibility, and voluntary self-consent perceptions after undergoing a hypothetical consent/assent process for a biomedical HIV study. Findings suggest participants found (...) the intervention feasible and acceptable. Participants in the intervention condition scored higher on a DC measure; however, scores did not meet the predetermined cutoff score for adequate DC in either group. The potential implications of these findings for research with youth, including YLWH, are discussed. (shrink)

This paper explores the impact of group affiliation with respect to the on-line processing and appreciation of jokes, using facial electromyography activity and offline evaluations as dependent measures. Two experiments were conducted in which group affiliation varied between the participant and each of two independent speakers whose described political profiles were distinguished through one word: “Right” versus “Left.” Experiment 1 showed that jokes were more highly evaluated and that associated EMG activity was more intense when it was later determined that (...) the speaker was a member of the listener’s ingroup rather than outgroup. In an effort to determine whether these parochial effects can be isolated to ingroup favoritism as opposed to outgroup derogation, Experiment 2 paired a joke-teller described as politically active with one who was described as politically neutral. These more subtle comparisons suggest that the parochial effects observed in our joke understanding paradigm are mediated, at least in part, by the presence of an outgroup member. (shrink)

This study examined self-reported academic dishonesty at a midsize public university. Students (N = 492) rated the likelihood they would cheat after accepting to abide by each of eight honor code pledges before Internet-based assignments and examinations. The statements were derived from honor pledges used by different universities across the United States and varied in length, formality, and the extent to which the statements included consequences for academic dishonesty. Longer, formal honor codes with consequences were associated with a lower likelihood (...) to cheat. Results showed a significant three-way interaction and suggest how to best design honor codes. Evolutionary social scientists know much already about how human reproductive behavior and human sociality fit into the larger pattern of human evolution. They still have much to learn, though, about the ways literature and the other arts enter into human nature. Our model of human nature draws on our knowledge of imaginative culture, integrates that knowledge with evolutionary theories of culture, and produces data that enable us to draw conclusions on an issue of broad significance for both literary study and evolutionary social science: the adaptive function of literature and the other arts.1In order to make advances in knowledge, it is necessary to choose some particular subject. Genetics is a basic science that applies to all organisms, but geneticists first got an empirical fix on their subject by focusing minutely, with Mendel, on peas, and, with Morgan, on fruit flies. In place of peas and flies, we have taken as our subject British novels of [End Page 50] the longer nineteenth century (Austen to Forster). As a literary topic, the subject is fairly broad, but our theoretical and methodological aims ultimately extend well beyond the specialist fields of British novels, the nineteenth century, British literature, narrative fiction, or even literary scholarship generally. This study is designed to engage the attention of literary scholars in all fields and also to engage the attention of social scientists. If it achieves its aims, this study would help persuade literary scholars that empirical methods offer rich opportunities for the advancement of knowledge about literature, and it would help persuade social scientists that the quantitative study of literature can shed important light on fundamental questions of human psychology and human social interaction. Our own research team combines these two prospective audiences. Two of us (Carroll and Gottschall) have been trained primarily as literary scholars, and two of us (Johnson and Kruger) primarily as social scientists.The focal point for this study is "agonistic" structure: the organization of characters into protagonists, antagonists, and minor characters. The central question in the study is this: does agonistic structure reflect evolved dispositions for forming cooperative social groups? Suppressing or muting competition within a social group enhances group solidarity and organizes the group psychologically for cooperative endeavor. Our chief hypothesis was that protagonists and good minor characters would form communities of cooperative endeavor and that antagonists would exemplify dominance behavior. If this hypothesis proved correct, the ethos reflected in the agonistic structure of the novels would replicate the egalitarian ethos of hunter-gatherers, who stigmatize and suppress status-seeking in potentially dominant individuals. If suppressing dominance in hunter-gatherers fulfills an adaptive social function, and if agonistic structure in the novels engages the same social dispositions that animate hunter-gatherers, our study would lend support to the hypothesis that literature fulfills an adaptive social function.2One of our chief working hypotheses is that when readers respond to characters in novels, they respond in much the same way, emotionally, as they respond to people in everyday life. They like or dislike them, admire them or despise them, fear them, feel sorry for them, or are amused by them. What is the primary function of consciousness in the nervous system? The answer to this question remains enigmatic, not so much because of a lack of relevant data, but because of the lack of a conceptual framework with which to interpret the data. To this end, we have developed Passive Frame Theory, an internally coherent framework that, from an action-based perspective, synthesizes empirically supported hypotheses from diverse fields of investigation. The theory proposes that the primary function of consciousness is well-circumscribed, (...) serving the 'somatic nervous system[. For this system, consciousness serves as a frame that constrains and directs skeletal muscle output, thereby yielding adaptive behavior. The mechanism by which consciousness achieves this is more counterintuitive, passive, and “low level” than the kinds of functions that theorists have previously attributed to consciousness. Passive frame theory begins to illuminate (a) what consciousness contributes to nervous function, (b) how consciousness achieves this function, and (c) the neuroanatomical substrates of conscious processes. Our untraditional, action-based perspective focuses on olfaction instead of on vision and is 'descriptive' (describing the products of nature as they evolved to be) rather than 'normative' (construing processes in terms of how they should function). Passive frame theory attempts to illuminate what consciousnessis, in mechanistic and functional terms; it does not address the “implementation” level of analysis (how neurons instantiate conscious states), an enigma for various disciplines. However, in response to the commentaries, we discuss how our framework provides clues regarding this enigma. In the framework, consciousness is passive albeit essential. Without consciousness, there would not be adaptive skeletomotor action.

Little is known about young children's ability to talk about absent members of their social network. We analyzed the speech of four children from 2 to 5 years. References to absent caregivers were relatively frequent, even when children were 2 years old. Such references were often generated spontaneously rather than being repetitions of a name produced by the child's interlocutor. Children's comments about absent family members occasionally expressed concern about contact with them but were predominantly neutral or reflective. This article discusses the possibility for vulnerable writing within feminist methodological approaches to research. Drawing upon a project that involved difficulties and tensions in conducting transnational research, including the documenting and telling of a partial narrative of an individual who set herself on fire, the article discusses what it might mean to focus more explicitly on explicating and recognising vulnerability in writing. In providing examples from working with a situated, localised analysis that engages feminist, postcolonial and queer theoretical approaches to (...) attend to the particular and everyday, I address some of the hesitations and uncertainties in undertaking research and producing knowledge, and concerns with forms of reflexive practice. At the heart of the discussion is the question of a vulnerable ethics, of how it is possible for feminist methods to represent the lives of others, especially when stories fail in the telling, both in providing adequate explanations and in the ways that trauma and suffering can remain incommunicable. Included in this are concerns as to how we as researchers are affected within the production of research. As a form of receptivity and wounding, the article argues for vulnerable writing that challenges feminist methods to remain open and receptive to what will always resist sense-making, while continuing to respond to the demand that we do justice to the lives of others. Constitutivism is the view that it is possible to derive contentful, normatively binding demands of practical reason and morality from the constitutive features of agency. Whereas much of the debate has focused on the constitutivist's ability to derive content, David Enoch has challenged her ability to generate normativity. Even if one can derive content from the constitutive aims of agency, one could simply demur: ?Bah! Agency, shmagency?. The ?Why be moral?? question would be replaced by the ?Why be an agent?? (...) question. It is the aim of this paper to show that the shmagency objection is essentially correct, though not as originally defended by Enoch. Since Enoch posed his argument as ruling out the normative authority of agency under any conception of the constitutive features of agency, constitutivists have responded by arguing for the inescapability of certain minimal features of agency. I argue that this amounts to equivocation: the constitutivist appeals to a minimal conception of agency in answering the normative question but to a richer understanding in answering the content question. The key to the shmagency objection, as I shall defend it, is to insist that the same sense of agency must be employed in answering both questions. A shmagent can concede that there may be inescapable ways of understanding agency, but insist that any such understanding would have to be too minimal to generate substantive content. (shrink)

This study proposes a multimodal fusion model to account for the cognitive mechanisms involving 56 political cartoons with regard to U.S. beef import issues as reported in two dominant Taiwanese newspapers, the Liberty Times and United Daily News. Specifically, this study claims that multimodal fusion model evolves from two metonymic-metaphoric networks, i.e., related metonymic network and diversified metaphoric network, and combines the conceptual, visual, and verbal modes. Our analysis demonstrates that multimodal fusion is a significant and recurrent representation technique in (...) the genre of political cartoon and has the cognitive function of encapsulating the abstract complex political debates efficiently with irony and humorous effect. Women in North America have many childbirth options. However, they must make these choices within a complex culture of birthing discourse characterized by competing knowledges and claims regarding the “ideal birth” as medicalized, natural, or woman centered. We interviewed 21 childless women and 22 new mothers to explore their perceptions of choice and birthing. The women’s interviews indicated that their birthing choices are reflective of tensions embedded in normative femininity; conflicting ideas relating to purity, dignity, and the messiness of birth; (...) and contradictions about women’s bodies as heteronormative sites of pleasure and sexuality on one hand and of asexual, selfless sources of maternal nurturance on the other. Finally, the women’s views reflected understandings of moral and normative constructs about selflessness as a core attribute of femininity and motherhood, particularly in terms of enduring pain as the “proper” means of accomplishing the rite of passage to motherhood. Although all the women described tensions between femininity and motherhood, childless women were more likely than mothers to be worried about achieving ideal, heteronormative sexuality and femininity. Likewise, women who have not yet had children and women who have experienced unplanned C-sections were more likely than those who experienced vaginal births to express that C-section births fail to fully accomplish women’s rite of passage to motherhood. It is to idealize this person, to think constantly (...) about him or her, and to discover that one's own life priorities have changed dramatically. It is to care deeply for that person's well-being and to feel pain or emptiness when he or she is absent.But is this intense emotional experience a universal experience, something that is characteristically and quintessentially human, or is it merely a sociocultural construct that belongs to a particular time and place? On this point there is less agreement, both within and between different academic disciplines. The audacious question we want to raise in the pages that follow is whether literature—or more specifically, a large-scale, multiple-coder content analysis of thousands of folk tales drawn from different parts of the planet—can contribute something to this difficult question about love, culture, and human nature.Let us first look briefly at the theoretical problem that we aim to address. A widespread view among literary scholars and social scientists over the last decades has been that romantic love is a social construction specific to Western culture. This is part of a relentless skepticism [End Page 450] toward assumptions that important categories of human psychology and emotion—romantic and parental love, gender, sexual orientation, and so on—are "natural" rather than constructed. This position is often, if not always, linked to an ideological concern to demystify (or at least problematize) what is perceived as an essentially destructive or oppressive emotion or belief. Taking her cue from Simone de Beauvoir, Marilyn Friedman gives no less than ten reasons why it may be problematic for women to fall in love with men. 1Of course, no argument of any kind can be strictly ideological in nature since it always involves empirical assumptions—either explicit or implicit—about the nature of things. For example, the psychoanalyst E. S. Persons opines that the "best evidence that romantic love is not hard-wired into the emotional repertoire of humanity but is a cultural construct is the fact that there are so many cultures in which it is virtually absent." 2 Another frequent argument for love's constructedness has been that "there is no definition that describes love throughout the ages or across cultures." 3In some literary-critical accounts, it is even argued that romantic love is a cultural invention that can be traced back with precision to the courtly troubadour culture of twelfth-century France. 4 According to yet another school, represented by the influential literary theorist Jonathan Culler, "the notion of romantic love (and its centrality to the lives of individuals) is arguably a massive literary creation." 5While the social constructivist position on romantic love typically involves a strong commitment to cultural specificity, a weaker version is held even by some cognitive theorists who grant more to biology and panhuman traits. From the perspective of their communicative theory of emotion, Philip Johnson-Laird and Keith Oatley argue that the "components [of romantic love] exist separately in different societies, but their integration into a recognizable complex is a cultural accomplishment [by the West]." 6At the other end of the romantic love continuum we find those who argue that this emotion belongs to a universal human nature: or, more specifically, that it can be attributed to specialised neural circuits whose ultimate purpose is to enhance reproductive success. Heterogeneity within MDD has hampered identification of biological markers (e.g., intermediate phenotypes, IPs) that might increase risk for the disorder or reflect closer links to the genes underlying the disease process. The newer characterizations of dimensions of MDD within Research Domain Criteria (RDoC) domains may align well with the goal of defining IPs. We compare a sample of 25 individuals with MDD compared to 29 age and education matched controls in multimodal assessment. The multimodal RDoC assessment included the primary IP (...) biomarker, positron emission tomography (PET) with a selective radiotracer for 5-HT1A ([11C]WAY-100635), as well as event-related functional MRI with a Go/No-go task targeting the Cognitive Control network, neuropsychological assessment of affective perception, negative memory bias and Cognitive Control domains. There was also an exploratory genetic analysis with the serotonin transporter (5-HTTLPR) and monamine oxidase A (MAO-A) genes. In regression analyses, lower 5-HT1A binding potential (BP) in the MDD group was related to diminished engagement of the Cognitive Control network, slowed resolution of interfering cognitive stimuli, one element of Cognitive Control. In contrast, higher/normative levels of 5-HT1A BP in MDD (only) was related to a substantial memory bias toward negative information, but intact resolution of interfering cognitive stimuli and greater engagement of Cognitive Control circuitry. The serotonin transporter risk allele was associated with lower 1a BP and the corresponding imaging and cognitive IPs in MDD. Lowered 5HT 1a BP was present in half of the MDD group relative to the control group. Lowered 5HT 1a BP may represent a subtype including decreased engagement of Cognitive Control network and impaired resolution of interfering cognitive stimuli. Future investigations might link lowered 1a BP to neurobiological pathways and markers, as well as probing subtype-specific treatment targets. (shrink)

My aim in this paper is to defend negligence as a legitimate basis for moral and criminal culpability. In so doing, I also hope to demonstrate how philosophical and jurisprudential perspectives on responsibility can mutually inform each other. While much of the paper focuses on criminal negligence, my aim is to show how attention to certain doctrines and concepts in criminal law can shed light on our understanding of moral culpability including culpability for negligence. It is often taken to be (...) a fundamental principle of criminal law that an act cannot be guilty unless it is accompanied by a culpable state of mind or mens rea. This has led to scepticism regarding negligence as a legitimate basis for desert-based criminal sanction because it is not clear that negligence picks out any mental state at all, much less a culpable one. In this paper I articulate and defend a unified account of moral and criminal culpability that rejects the standard view of mens rea that underlies negligence-skepticism. Specifically, I hold that the mens rea element of a crime does not function to inculpate, as is standardly held, but to partly determine the description under which an action counts as wrongful. While I agree that we should be especially cautious about criminalizing negligence, the relevant question, on my view, is not whether a given mens is sufficiently culpable but whether the mens-cum-actus is sufficiently wrongful to warrant the attention of criminal justice. Physics is the most fundamental of all the sciences, so it is the trunk of the tree. The branch of chemistry emerges from physics, because the laws of chemistry (...) depend on the laws of physics: chemical reactions occur the way they do because of the physical properties of atoms. Biology's branch splits off from chemistry's: the molecules that comprise living things are bound by the rules of chemistry. Scientists, while grasping this fundamental interconnection of the broad boughs of the natural sciences, 1 have rarely craned their necks sufficiently to glimpse the upper reaches of the tree of knowledge: the green canopy of human culture that is the traditional jurisdiction of the social sciences and humanities. In fact, scholars from all disciplines have mostly proceeded as though the greenery above was the outgrowth of a neighboring tree from a fundamentally different species.Since the 1960s, however, a maverick band of Darwinian neck-craners have been demonstrating that the stuff of human culture, studied in the humanities and social sciences, is a contiguous part of the tree of knowledge: human culture and behavior grow out of human biology. 2 These scholars and scientists continue to define themselves by different names depending on subtleties in their particular approaches: Darwinian psychology, sociobiology, Darwinian anthropology, biosociology, human behavioral ecology, human ethology, and evolutionary psychology. 3 However, sacrificing some precision on the alter of clarity, I will refer to all of the above approaches with the umbrella term of human [End Page 255] behavioral biology, understood in its most expansive sense as the study of how millions of years of evolution shaped the human mind, and thus human behavior, and thus human culture. No matter how human behavioral biologists define their work, they all share the conviction that human behavior, psychology, and culture cannot be fully understood separate from human bio-evolutionary history.Darwinian excavation of the foundations of human nature has inspired a revolutionary movement in the social sciences that proceeds to this day. Like most revolutions, this one has seen its share of rolling heads and intellectual bloodshed. Starting with the "sociobiology debates" of the late 1970s through mid-80s and continuing through the "science wars" of the early-mid 1990s allegations and recriminations of the most serious sort have been almost casually poured into the air: racism, sexism, Social Darwinism, biological determinism, disciplinary colonialism, disciplinary xenophobia, and "biophobia." 4 However, despite entrenched, sometimes zealous opposition, evolutionary thinking has firmly established itself in the social sciences. Thumbing through leading social science journals, it is no longer a shock to encounter articles exploring traditional topics with shiny new Darwinian tools. This stands in stark contrast to the situation in the decades immediately following World War II, where applying biology to human behavior and culture was virtually taboo. In fact, the UNESCO statement of 1952 explicitly tabooed human behavioral biology as scientifically and politically incorrect. Moreover, this phenomenon is in marked contrast to the mainstream social science of the late 1970s and early 1980s, which was in the midst of a wicked backlash against the resurgence of biological inquiry into behavior represented in sociobiology.Currently, while human behavioral biology retains many social scientist critics, and while certain social science fields remain largely hostile or indifferent, invoking biology to explain social behavior is moving toward the mainstream. Almost thirty years after E. O. Literary scholars are generally suspicious of the concept of universals: there are presently no candidates for literary universals that a high proportion of literary scholars would accept as valid. This paper reports results from a content analysis of patterns of characterization in folktales from 48 culture areas, aimed at identifying patterns of characterization that apply across regions of the world and levels of cultural complexity. The search for these patterns was guided by evolutionary theory and the findings are consistent with (...) previous research on patterns of altruism, sex differences in mate preferences, sex differences in reproductive strategy, and differing emphases on male and female physical attractiveness. World literature, especially originally oral literature, represents a vast and neglected repository of information that researchers can use to more precisely map the contours of human nature. Local food systems can have economic and social benefits by providing income for producers and improving community connections. Ongoing global climate change and the acute COVID-19 pandemic crisis have shown the importance of building equity and resilience in local food systems. We interviewed ten stakeholders from organizations and institutions in a U.S. midwestern city exploring views on past, current, and future conditions to address the following two objectives: 1) Assess how local food system equity and resilience were impacted by the (...) COVID-19 pandemic, and 2) Examine how policy and behavior changes could support greater equity and resilience within urban local food systems. We used the Community Capitals Framework to organize interviewees’ responses for qualitative analyses of equity and resilience. Four types of community capital were emphasized by stakeholders: cultural and social, natural, and political capital. Participants stated that the local food system in this city is small; more weaknesses in food access, land access, and governance were described than were strengths in both pre- and post-pandemic conditions. Stakeholder responses also reflected lack of equity and resilience in the local food system, which was most pronounced for cultural and social, natural and political capitals. However, local producers’ resilience during the pandemic, which we categorized as human capital, was a notable strength. An improved future food system could incorporate changes in infrastructure (e.g., food processing), markets (e.g., values-based markets) and cultural values (e.g., valuing local food through connections between local producers and consumers). These insights could inform policy and enhance community initiatives and behavior changes to build more equitable and resilient local food systems in urban areas throughout the U.S. Midwest. This paper takes up the question of whether the consequences of a person’s volitional actions can contribute to their blameworthiness. On the one hand it is intuitively plausible to hold that if D1 volitionally shoots V with the intention of killing V then D1 is blameworthy for V’s death. On the other hand, if the only difference between D1 and D2 is resultant luck, many find it counter-intuitive to hold that D1 is more blameworthy than D2. There are three broad (...) (non-skeptical) strategies for resolving this tension: accept resultant moral luck, deny that one can be morally responsible for outcomes, or accept that outcomes can be within the scope of things one is morally responsible for while denying that they can affect the degree of blameworthiness. This paper aims to defend resultant moral luck against both the scoping and the internalist strategies by drawing on an “inclusive conception” of blameworthiness, according to which how much blame one deserves is a function of two independent variables: the wrongfulness of the offense and the offender’s degree of moral responsibility. The view defended here holds that consequences affect degree of blameworthiness by affecting the wrongfulness of that for which one is being blamed. (shrink)

BackgroundPeople with upper extremity amputations report receiving insufficient information about treatment options. Furthermore, patients commonly report not knowing what questions to ask providers. A question prompt sheet, or list of questions, can support patient-centered care by empowering patients to ask questions important to them, promoting patient-provider communication, and increasing patient knowledge. This study assessed information needs among people with UE amputations about UE vascularized composite allotransplantation and developed a UE VCA-QPS.MethodsThis multi-site, cross-sectional, mixed-methods study involved in-depth and semi-structured interviews with (...) people with UE amputations to assess information needs and develop a UE VCA-QPS. Qualitative data were analyzed by thematic analysis; quantitative data were analyzed by descriptive statistics. The initial UE VCA-QPS included 130 items across 18 topics.ResultsEighty-nine people with UE amputations participated. Most were male, had a mean age of 46 years, and had a unilateral and below-elbow amputation. Participants desired information about UE VCA eligibility, evaluation process, surgery, risks, rehabilitation, and functional outcomes. After refinement, the final UE VCA-QPS included 35 items, across 9 topics. All items were written at a ≤ 6th grade reading level. Most semi-structured interview participants reported being ‘completely’ or ‘very’ likely to use a UE VCA-QPS.ConclusionPeople with UE amputations have extensive information needs about UE VCA. The UE VCA-QPS aims to address patients’ information needs and foster patient-centered care. Future research should assess whether the UE VCA-QPS facilitates patient-provider discussion and informed decision-making for UE VCA. (shrink)

While Spain was conquering new lands in the Americas, foreigners arrived into their own—the Gitanos. Spain imposed a double-standard whereby their crossing into new, occupied, territory was legitimate, but the entry of others into Spanish territory was not. I compare and contrast these historically parallel movements of people using Deleuze and Guattari’s taxonomy of movement. I conclude that the double-standard of movement was due to differences of power between these two groups, understood in terms of material conditions, a prototypical “racial (...) contract,” and differences in the relationship to land and space. This history and analysis of colonial Spain is a critical start for Latin American postcolonial theory; it gives us a framework to study philosophies of migration and nomadism; and finally, it introduces the Gitanos as an important population to complicate critical race theory or theories of ethnicity. Both the music and subculture of punk historically arose from disaffected working-class youth. This socio-economic starting point was absolutely crucial for making punk what it is. However, along with this standpoint came various levels of class consciousness that we can see evidence of in the lyrics and in various practices of people within the scene itself. I divide this consciousness into 3 specific levels of structural understanding and agency. Inspired by Georg Lukacs' analysis of class consciousness and Antonio Gramsci's theory (...) of hegemony, I demonstrate how punk as a subculture and musical art form is a notable demonstration of "proletarian culture". But just as the revolutionary potential of the proletariat hinges on a unified ideology and consolidated and consistent praxis, so too does the revolutionary potential of punk. This article explores the role of second-order anger in the formation of resistant feminist space through the work of María Lugones and Sara Ahmed. I argue that this incommunicative form of anger can operate as a bridge between two senses of resistant spatiality in Lugones, connecting the hangout, which is a collective and transgressive space for alternative sense making, and the cocoon, which is a solitary and germinative space of tense internal transformation. By weaving connections with Ahmed’s concept of feminist (...) fragile sheltering, I demonstrate that the insulating character of second-order anger need not be equated with spatial solitude. Rather, given its orientation toward a future becoming away from oppressed subjectivity, germinative cocooning can be understood as constitutive of collective, feminist, and resistant spaces. I conclude, therefore, that feminist spaces ought to shelter second-order angers and embrace fragility as a condition of resistant transformation. (shrink)

Friedrich Nietzsche argued in the nineteenth century that museums can be no more than mausoleums for effete (fine) art.1 Over the course of the twentieth century, however, curators dispelled such blanket pessimism by showing that what keeps historical art (...) museums, both comprehensive and modern, "alive" and relevant in the modern art world are the things that curators do with the artworks in their collections.2 In certain cases, I will argue in this article, the focus on artworks and the relationship between them can be rewardingly shifted onto the spatial aspect of the museum. I will try to show what such a shift of focus entails, show that it involves a gestalt shift (in Wittgenstein's terms, the "dawning of an aspect"), and illustrate the limits within which this can arise.3 The foremost of these limiting factors is museum architecture, and I will discuss this to the extent that it determines the limits of what curators can do. How architects do things with museums, however, lies outside the scope of this article.An Art Historical Heuristic Gets a Curatorial MakeoverNineteenth-century art museums typically were vast, labyrinthine, and built to assume the shape of a comprehensive art historical narrative, so they were easy targets for ideologues drawn to vibrant modern artworks and the controversy surrounding them. At the turn of the twentieth century new commercial galleries developed a distinctively modern mode of display in which individual artworks were showcased with plenty of space around them.4 Had existing museums changed their ways to accommodate these developments, the momentum of a new aesthetic of flatness, surface, [End Page 87] and yet purer forms of conceptualism would have been lost. It was not a time for absorption and deflation: new museums, no less monumental and historical but smaller and with fewer volumes, were commissioned to give modern art the appearance of a fresh start.5 The weightless upward mobility of Frank Lloyd Wright's Guggenheim Museum in Manhattan, modeled in 1945 and opened to the public in 1959, consummated this trend of the first half of the twentieth century and gave it its purest form. What the building spurt revealed was that as art changes, it demands to be reflected in its surroundings, not merely accommodated. That the response was to build new museums rather than new wings suggests the inner workings of the principle—call it "curatorial heuristic one"—that, whereas art history is fluid and simply flows forward with new developments, museums are not of this nature; they can become effete.The curatorial revision of this heuristic was a century in coming. As often happens when emerging movements are yet underdetermined, modernism suppressed in its beginnings the background factor that would seem to entail the end of modern art when finally brought into focus: the very context of display that had once set it apart. Duchamp's Readymades (1913) gave the initial nod (or wink) to the gallery context; it was, however, ignored, as a suppressed punch line, until art history was ready to concede the importance of the context of display—not in the gallery, but in the museum—to a site-specific artwork by Richard Serra: his Splashing and Prop (1968). With the museum's framing context and, concomitantly, the importance of the curator's work conceded, the barrier that had kept lesser masterpieces in the basement (or out of the museum) were removed. Unearthed, these began to circulate, and attention centered on the relation in which they stood to better-known artworks, either as suppressed alternates or as descendants of an artistic lineage. This study investigates how firms in the gambling industry manage their corporate social disclosures about controversial issues. We performed thematic content analysis of CSDs about responsible gambling, money laundering prevention and environmental protection in the annual reports and stand-alone CSR reports of four USA-based multinational gambling firms and their four Macao counterparts. This study draws on impression management theory, camouflage theory and corporate integrity theory to examine the gambling firms’ CSDs. We infer that the CSD strategies of gambling firms in (...) Macao and the USA did not serve as vehicles for reflexivity about social responsibility or social responsiveness. Instead, the firms camouflaged legitimacy gaps about sensitive topics by adopting assertive or defensive façades, disclaiming ethical responsibility, curtailing disclosure, or offering zero disclosure. Differences between CSD strategies according to topic, location, time, and reporting channel appear to reflect four factors: pressure to report, availability of good news, whether a firm was assuming ethical responsibility for addressing the topic, and the prospective readership. This study extends our understanding of the contextual and topic-specific factors affecting the quantity and character of CSDs by firms in a contested industry. (shrink)

This paper has two main goals. The first is to defend a particular account of answerability according to which a person is (morally or criminally) answerable for their conduct if it is (morally or criminally) wrongful under the same description under which it is imputable to their agency. Negating defences in law aim to defeat criminal answerability by negating some element of the charged offence while their moral analogues aim to defeat moral answerability by defeating the aptness of the description (...) under which an action is imputed. In contrast, affirmative defences and their moral analogues aim to defeat the move from answerability to liability to sanction by offering an exculpatory explanation for the wrongful conduct. The second goal of this paper is to argue that there are important differences between the way that ignorance functions in negating defences and their moral analogues and affirmative defences and their moral analogues. Specifically, when ignorance functions to defeat answerability, it need only be sincere, but it is typically limited to matters of fact, whereas both moral and non-moral ignorance can excuse one from liability but only if non-culpable. This paper attempts to investigate how and why organisations in Macao’s gambling industry engage in corporate social responsibility. It is based on an in-depth investigation of Macao’s gambling industry with 49 semi-structured interviews, conducted in 2011. We found that firms within the industry were emphasising pragmatic legitimacy based on both economic and non-economic contributions, in order to project positive images of the industry, while glossing over two domains of adverse externalities: problem gambling among visitors, and the pollution and despoliation of (...) the environment. By engaging symbolically rather than substantively in CSR, the gambling firms were diverting attention away from issues of moral legitimacy, in order to be allowed to continue to pursue “business as usual” as a means of obtaining substantial financial returns in a social, cultural and socio-political context that was exerting relatively little public pressure to improve corporate social and environmental performance. Richard T. Ely was one of the most important architects of the administrative welfare state in the United States. His astonishingly influential career was the product of a fundamental re-thinking of the origin and nature of the state. Repudiating the social compact theory of the American founding in favor of a self-consciously “new,” “German,” and frankly “social” conception of the state ordered toward the realization of a collective vision of human perfection, Ely conceived the task of social reform as extending (...) social control over the hereditary and environmental determinants of human character. In the early 1930s, Ely’s vision of social reform would inspire some of his boldest students, especially M. L. Wilson, to formulate a sweeping vision of social planning that would not only inform his little known and rather coyly named Division of Subsistence Homesteads, but also his efforts at the National Resources Board —the nation’s first ever agency for comprehensive national planning. Over 10 years ago, Pax‐6 was shown to play an evolutionarily conserved role in controlling eye formation from Drosophila to humans.1 Since then, the identification of an entire cascade of conserved eye determination genes has brought a new understanding to the developmental relationship between the insect compound eye and the vertebrate camera eye.2 Additional studies are now beginning to suggest that even late aspects of eye development, including cell type specification, also share common molecular machinery. In this commentary, I will (...) discuss some of these findings, with a particular focus on the recent study by Dyer et al.3 describing a novel role for the Prox1 transcription factor in specifying horizontal cells in the mouse retina. As Prospero, the Drosophila homolog of Prox1, also participates in retinal cell specification, these data provide a forum for asking new questions concerning pathways that may regulate retinogenesis across evolution.
